This presentation will focus on a new approach (in Nebraska) to resolving the seemingly unresolvable divorce matters without losing control by going to court, while still giving your clients the chance to be heard. Settlement facilitation can result in better outcomes for parties, fewer client complaints, and still make sure the lawyers involved can meet their bottom lines in an ethical and client focused manner.
Settlement Facilitation is a hybrid settlement model comprised of aspects of different methods for dispute resolution including mediation, negotiation, early neutral evaluation, and settlement conferences. Settlement Facilitation helps the parties realistically evaluate the strengths and weaknesses of their positions and their risks at trial, with the goal of achieving a fair settlement with which both parties will be satisfied.
