In 2020, the U.S. Supreme Court held that the Muscogee Creek Nation's reservation in eastern Oklahoma had never been disestablished by Congress and was still "Indian country" in McGirt v. Oklahoma, 591 U.S. __ (2020). Following this decision, other Indian reservations in Oklahoma were recognized as having never been properly disestablished, making much of eastern Oklahoma "Indian country." On June 29, 2022, in Oklahoma v. Castro-Huerta, 597 U.S. ___ (2022), the Supreme Court held that the Federal Government and the State have concurrent jurisdiction to prosecute criminal offenses committed by non-Indians against Indians in Indian country. This is a departure from what has long been considered settled Federal Indian law and the Indian Canons of Construction. This CLE will discuss the history of Federal Indian law leading up to the Castro-Huerta decision, the decision itself and potential implications for the future of Federal Indian law, and upcoming Supreme Court cases.
Jennifer Bear Eagle: Ms. Bear Eagle is a Senior Associate Attorney at Big Fire Law & Policy Group, LLP. She has extensive experience working with Indian tribes in all areas of tribal governance and self-determination. She previously served as lead general counsel for the Oglala Sioux Tribe and the Oglala Sioux Tribal Council. She is a past Chairperson of the Nebraska Commission on Indian Affairs. Ms. Bear Eagle is the current Chairperson and one of the Indian Law Section co-founders.
Andrea Snowball: Ms. Snowball is an Associate Attorney with Big Fire Law & Policy Group, practicing primarily transactional work for tribes, tribal entities, and tribal members. She is a 2020 graduate of Creighton University School of Law.
Olivia Lehman: Olivia Lehman is a third-year law student at Creighton University. She is a member of Phi Delta Phi Honor Society, and the student problem director of Creighton’s 2022 Moot Court Competition. She works as a law clerk at Big Fire Law & Policy Group LLP.
