Hour One – U.S. Supreme Court Review and Constitutional Law Update
This one-hour CLE program will provide an update on recent decisions from the U.S. Supreme Court and other new constitutional law decisions.
- Richard F.Duncan, Professor, University of Nebraska College of Law: Richard F.Duncan, Professor, University of Nebraska College of Law: ProfessorDuncan joined the faculty in 1979. He received his B.A. degree from the University of Massachusetts (Amherst) in 1973. In 1976, he received his J.D. degree from the Cornell Law School, where he served on the Board of Editors of the Cornell Law Review. He was admitted to the New York Bar in 1977. From 1976-79, he was associated with White & Case, a New York City law firm. ProfessorDuncan teaches Property, Constitutional Law, and First Amendment. He is a passionate and enthusiastic classroom teacher, whose style is not so much Socratic Dialogue as Socratic Performance Art. He spends most of his passion and energy teaching, writing, and speaking about social justice issues such as the right-to-life, religious liberty, freedom of speech, the pursuit of happiness, and other inalienable rights and liberties. He has spoken and debated at nearly 100 law schools on numerous issues concerning social justice and constitutional law. He loves teaching at Nebraska Law, especially in Room 113 which he claims to own by adverse possession. His favorite legal idea is “first come rights, then comes government to secure those rights.
Hour Two – The Supreme Court, DEI and the Ethics of Language
During this seminar, the presenters will examine the interplay between recent Supreme Court decisions, language, and the law.
- Jeff Downing, Keating, O'Gara, Nedved & Peter, P.C., L.L.O.Jeff Downing is a third generation Nebraska lawyer. For his success in the courtroom, Mr. Downing was inducted into the American Board of Trial Advocates, an invitation-only association of trial attorneys. He is “AV” rated by his fellow attorneys and the judges before whom he practices for possessing the highest legal ability and ethical standards. He is also a member of the U.S. Supreme Court Bar and a Lifetime Fellow of the Nebraska State Bar Foundation. For his advocacy in constitutional litigation, Mr. Downing was inducted into the ADF Honor Guard. Mr. Downing has presented at numerous CLE events and serves the Christian Legal Society by coordinating educational opportunities for Nebraska lawyers on topics ranging from Constitutional Law to Legal Ethics.

Active Nebraska attorneys are required to complete 10 hours of continuing legal education (CLE) each year. Two of those 10 hours must be in the field of professional responsibility (ethics). Nebraska attorneys may claim only 5 hours of distance-learning CLE per year. Webinars viewed on this portal are considered distance-learning. Under the new MCLE reporting process, the NSBA will report your attendance for this program, which will be automatically updated into your transcript. The NSBA has 30 days to report your hours to Nebraska MCLE, and your transcript may not update immediately. You are no longer able to log your own hours in your transcript; they must be reported by the sponsor.
