This presentation will be an overview of landlord-tenant law in Nebraska, focusing on eviction litigation: how it works, the unique timeline and statutory requirements, and strategies for defending a tenant in eviction court. Dugger will share tips on client counseling, negotiation with opposing counsels, and motion practice in this unique environment—in short, all an attorney would need to know before volunteering with TAP!
Alan Dugger is the Managing Attorney for the NSBA’s Volunteer Lawyers’ Project’s Tenant Assistance Project, where he directs the day-to-day operations of the largest eviction defense program in Nebraska. Prior to joining VLP, he was a fellow at the University of Nebraska College of Law’s Housing Justice Clinic. There, he taught senior-certified law students how to conduct all aspects of eviction defense and actively supervised their cases. During his time at the Clinic, he successfully defended over 300 tenant families from immediate eviction.

Active Nebraska attorneys are required to complete 10 hours of continuing legal education (CLE) each year. Two of those 10 hours must be in the field of professional responsibility (ethics). Nebraska attorneys may claim only 5 hours of distance-learning CLE per year. Webinars viewed on this portal are considered distance-learning. Under the new MCLE reporting process, the NSBA will report your attendance for this program, which will be automatically updated into your transcript. The NSBA has 30 days to report your hours to Nebraska MCLE, and your transcript may not update immediately. You are no longer able to log your own hours in your transcript; they must be reported by the sponsor.
