Join the NSBA as we welcome Professor Lenich to review the amendments to the Nebraska Court Rules of Discovery in Civil Cases (Neb. Ct. R. Disc. §§ 6-326 to 6-337). This session will focus primarily on the changes to Rules §§ 6-330 to 6-337, the rules that govern discovery methods and sanctions. The amendments include new provisions on taking depositions by videoconferencing and telephone, making and waiving objections to written discovery requests, responding to requests for production, precluding parties from using subpoenas duces tecum to circumvent the notice requirements for document subpoenas, the mechanics of filing motions to compel, and the requirements for and the types of sanctions that can be imposed for failing to preserve electronically stored information. If time permits, the session will include a discussion of some of the new provisions in the Pleading Rules (Neb. Ct. R. Pldg. §§ 6-1101 to 1115).
